Standard mutual NDA
Discretion is not an option at Reputation Partners. This agreement applies by default to every request and every file, to both sides, from the first message and after closing.
Last updated: October 24, 2026When it applies
This mutual non-disclosure agreement ("NDA") applies automatically when you send a request through any form on this website, when you write to the desk, and throughout any engagement you give us. You accept it when you tick the consent box on a form or when you reply to us. A signed copy can be issued for your records at any time; its terms are the same.
Parties
The NDA binds Hush Partners LLC ("Reputation Partners", "we"), registered at 108 West 13th Street, Wilmington, New Castle, Delaware 19801, and you, together with the person, family or organization you act for ("you"). Where a file involves several people, each of them is bound to us by this NDA, and we hold each one's information separately.
Confidential information
Confidential information means anything disclosed in connection with a request or a file, in any form, including:
- the identity of the client, their family, advisers and the people acting for them
- the fact that a request, an audit or an engagement exists
- the name, brand or content concerned, the links and the evidence provided
- the plan, the targets, the strategy and the status of every removal or suppression request
- prices, quotes, terms and correspondence, and any document provided to verify identity or authority
Obligations
Each party will use confidential information only to assess and carry out the engagement concerned, protect it with at least the care it gives its own confidential information, and share it only with its own staff and professional advisers who need it and are bound by equivalent confidentiality. When we contact a search engine, platform or publisher on your behalf, we share only the minimum the request needs, and never the fact that we act for a named client unless you have agreed to it.
Exclusions
The obligations do not apply to information that is or becomes public through no breach of this NDA, that the receiving party already held lawfully, that it receives lawfully from a third party free to disclose it, or that it develops independently. A party may disclose information when required by law or by a competent authority, after informing the other party where the law allows it.
Public records
Search results, news articles, court records and posts are public by nature. This NDA does not restrict anyone from reading them. It does restrict linking a public record to a client, a strategy or an engagement that was disclosed in confidence.
No announcement
No party will announce, publish or comment on an engagement or the other party's involvement without the other party's written consent. We never use a client, a counterparty or a case as a reference, a testimonial or a logo. Our case files are anonymized, and details are changed so that no client can be recognized.
Duration
The NDA starts with your first message and continues after a file closes or ends without an engagement. The obligations have no end date: what was confidential stays confidential. The information itself is kept only for as long as the exchange or the engagement lasts, then deleted.
Return and deletion
On written request, each party will delete or return the other's confidential information, except copies it must keep by law or within routine backups, which remain covered by this NDA. Our retention periods are set out in the privacy policy.
Remedies
A breach may cause harm that money cannot fully repair. Each party may seek injunctive relief in addition to any other remedy. This NDA creates no obligation to enter into an engagement, and no licence or right over any content.
Governing law
This NDA is governed by the laws of Delaware, and the courts of Delaware have exclusive jurisdiction. Questions about it: contact the desk. It works alongside our terms of use and privacy policy.
